Do we Need Term Limits for the Supreme Court?
Is it time to amend the Constitution to eliminate Lifetime Tenure for Supreme Court Justices?
Established by Article III of the Constitution…justices serve as long as they want to. The only language regarding removal of a justice is this: they can serve as long as they exhibit “good behavior”. A justice can be removed through impeachment…yet, it’s never happened.
A justices task is to interpret the Constitution. The focus is on the Constitution…not a particular judges thoughts on life or what the Constitution should state. Justices are appointed by the President and confirmed by the Senate. These justices are not suppose to represent a particular party. As we know, this isn’t the case! As of today, we know which one’s are liberal and which are conservative.
In my opinion, judicial activism is out of control. There’s no question this particular branch of government has at times been politicized. But we are seeing new heights of activism at work.
THERE IS NO CHECK AND BALANCE ON THE SUPREME COURT AND A JUSTICE! IT’S NOT THE SENATE WHEN CONFIRMING…THAT’S POLITICAL, TOO.
The concept of a lifetime tenure was to provide security to a justice. Theoretically, they would “interpret” the Constitution with integrity and not act in a way as to gain a vote seeking re-election.
Again, I ask…is a lifetime appointment too long?
